HYPERFX WARRANTY policy
HYPERFX® STRENGTH SERIES
NO FUSS MANUFACTURER’S WARRANTY
HYPERFX Strength Series equipment is designed and manufactured for demanding commercial training environments. We stand behind the quality, durability and structural integrity of our equipment with a straightforward No Fuss Manufacturer’s Warranty.
1. WARRANTY COVER
1.1 10 Year Structural Parts Replacement Warranty
HYPERFX warrants the structural frame and structural components of HYPERFX Strength Series equipment against defects in materials and workmanship for a period of 10 years from the original date of purchase.
Where a covered structural component fails during the warranty period, HYPERFX will repair or replace the affected component at its discretion.
1.2 10 Year Cable Warranty
All original cables fitted to HYPERFX Strength Series equipment are covered for 10 years from the original date of purchase against failure arising from a defect in materials or workmanship under normal intended use.
Where a cable fails due to a covered defect during the warranty period, HYPERFX will supply a replacement cable at no charge.
The cable warranty does not cover cosmetic deterioration, surface marking or other conditions that do not affect the safe and normal operation of the cable, or deterioration caused by fair wear and tear, misuse, inadequate maintenance or environmental conditions.
1.3 12 Month Padding & Upholstery Warranty
Original padding, foam and upholstery supplied with HYPERFX Strength Series equipment are warranted for 12 months from the original date of purchase against defects in materials or workmanship.
This warranty covers manufacturing defects such as premature failure of stitching, seams, upholstery materials, padding or foam where HYPERFX determines that the failure is attributable to a defect in the original material or manufacture.
Normal compression, softening, deformation, creasing, stretching, discolouration, marking or gradual deterioration resulting from commercial use is considered fair wear and tear and is not covered.
Tears, cuts, punctures, burns, abrasions or damage caused by misuse, impact, clothing or accessories, sharp objects, incorrect cleaning products, chemicals, excessive moisture, environmental exposure or other external causes are also excluded.
Where a valid manufacturing defect is identified within the 12 month warranty period, HYPERFX will, at its discretion, repair or replace the affected padding or upholstery component.
1.4 12 Month Labour Warranty
HYPERFX provides a 12 month labour warranty from the original date of purchase.
During this period, where an approved warranty repair requires a technician, reasonable labour costs associated with the repair or replacement of a warranted component will be covered by HYPERFX, subject to prior approval.
After the first 12 months, replacement parts that remain covered by an applicable warranty will continue to be supplied in accordance with this warranty; however, labour, installation, technician and associated service costs will be the responsibility of the equipment owner.
2. CALL-OUT, TRAVEL & LABOUR FEES
During the 12 month labour warranty period, where a warranty claim has been assessed and approved by HYPERFX, reasonable technician labour, call-out and travel costs required to complete the approved warranty repair will be covered by HYPERFX.
Where equipment is located in a remote or difficult-to-access location, or where attendance requires exceptional travel, accommodation, flights, specialised access or other extraordinary costs, HYPERFX may advise the customer of any additional charges before arranging attendance.
After the 12 month labour warranty period has expired, any labour, technician call-out, travel, accommodation, freight, parking, site access, installation or other service-related costs associated with inspecting, repairing or replacing equipment will be the responsibility of the equipment owner, even where the replacement part itself remains covered under the applicable HYPERFX parts warranty.
For example, where a structural component or cable is approved for replacement under the 10 year warranty after the first 12 months, HYPERFX will provide the covered replacement part in accordance with this warranty; however, the customer will be responsible for any applicable technician labour, call-out, travel and installation costs.
Where charges apply, HYPERFX or its authorised service provider will advise the customer of the applicable costs before arranging attendance wherever reasonably practicable.
3. FAIR WEAR & TEAR
This warranty covers manufacturing defects and premature failure attributable to defects in materials or workmanship. It does not cover fair wear and tear arising from the normal use of commercial fitness equipment.
Wear items and cosmetic components include, but are not limited to:
upholstery;
padding and foam;
grips and handles;
belts;
bearings and bushes;
pulleys;
plastic covers and shrouds;
decals and labels;
paint and powder-coated finishes;
rubber components;
footplates; and
other surfaces or components subject to regular user contact, friction, movement or impact.
These items are not covered where their deterioration is consistent with normal use, except where a separate warranty is expressly provided under this document, such as the 12 month Padding & Upholstery Warranty.
For the avoidance of doubt, normal compression, softening, deformation, creasing, marking, scratching, fading or gradual deterioration resulting from regular commercial use is considered fair wear and tear and is not a manufacturing defect.
4. ENVIRONMENTAL CONDITIONS & EQUIPMENT LOCATION
HYPERFX Strength Series equipment is designed primarily for use in indoor, dry and appropriately ventilated commercial fitness environments, unless a particular product is expressly identified by HYPERFX as suitable for outdoor, wet-area or other specialised environmental use.
The warranty does not cover corrosion, rust, deterioration, premature component failure, cosmetic damage or other damage caused or contributed to by the environment in which the equipment is installed, stored or operated.
This includes, but is not limited to, equipment installed or used:
in or immediately adjacent to swimming pools, spas, saunas, steam rooms or wet areas;
in areas subject to high humidity, condensation, steam or excessive moisture;
in outdoor or partially outdoor environments, including covered outdoor areas, balconies, terraces, open-sided training areas or locations exposed to weather;
in locations subject to rain, water ingress, irrigation, overspray, regular washing or hosing;
in coastal or marine environments where equipment may be exposed to salt air, sea spray or elevated atmospheric salinity;
in areas exposed to chlorine, pool chemicals, cleaning chemicals, corrosive substances or chemical vapours;
in areas with insufficient ventilation or where condensation is permitted to regularly form on the equipment; or
in any other environment that may reasonably accelerate corrosion, oxidation or deterioration of the equipment or its components.
The fact that equipment is installed under a roof, awning or other form of cover does not necessarily constitute an indoor or dry environment for the purposes of this warranty.
Where HYPERFX equipment is intended to be installed in a location with elevated humidity, marine exposure, proximity to pools or wet areas, or other potentially corrosive environmental conditions, the purchaser is responsible for advising HYPERFX before installation so that the suitability of the equipment and any additional protection or maintenance requirements can be considered.
HYPERFX may recommend additional preventative maintenance, protective coatings, cleaning procedures, inspection intervals or other measures for equipment installed in higher-risk environments.
Compliance with these recommendations does not extend warranty coverage to environmental deterioration unless HYPERFX has expressly confirmed such coverage in writing.
Surface rust, corrosion, oxidation, deterioration of coatings or finishes, and component failure caused or contributed to by environmental exposure are not considered manufacturing defects and are excluded from the HYPERFX Manufacturer’s Warranty.
Where equipment has been specifically sold by HYPERFX as suitable for outdoor, poolside, marine, wet-area or other specialised environmental use, any separate warranty conditions issued for that product or installation will apply.
5. MISUSE, ABUSE & IMPROPER USE
The HYPERFX warranty does not cover damage or failure caused or contributed to by:
misuse, abuse, neglect or deliberate damage;
dropping, throwing, slamming or striking equipment, weight stacks or moving components;
using equipment for a purpose other than its intended design;
exceeding stated equipment, resistance or user weight limits;
incorrect installation, relocation or assembly by an unauthorised person;
unauthorised modifications or alterations;
use of non-approved or incompatible replacement parts;
failure to carry out reasonable cleaning, inspection or preventative maintenance;
corrosion or deterioration caused by excessive moisture, sweat, chemicals, outdoor exposure or unsuitable environmental conditions;
accidents, flooding, fire, power issues, natural events or circumstances outside the reasonable control of HYPERFX; or
continued use of equipment after a fault, unusual noise, damage or safety issue has become apparent where that continued use causes or contributes to further damage.
6. APPROVED DEALER WARRANTY SUPPORT
Where HYPERFX Strength Series equipment has been purchased through an authorised HYPERFX dealer, distributor or reseller, that dealer will be the customer's primary point of contact for warranty support and service.
Where a warranty claim has been assessed and approved by HYPERFX, replacement parts required to complete the approved warranty repair will generally be supplied directly to the authorised dealer that originally supplied the equipment.
The selling dealer is expected to coordinate and carry out the approved warranty repair on behalf of its customer, including arranging technician attendance where required, installing or replacing the warranted component and managing communication with the customer throughout the warranty process.
During the applicable 12 month labour warranty period, approved and reasonable labour, call-out and travel costs incurred by the authorised dealer in completing an approved warranty repair will be covered or reimbursed by HYPERFX in accordance with HYPERFX's approved warranty service rates and procedures.
All labour, call-out, travel or other costs to be charged to HYPERFX must be approved by HYPERFX before the work is undertaken in order to qualify for payment or reimbursement.
After the 12 month labour warranty period has expired, HYPERFX will continue to supply approved replacement parts that remain covered by the applicable parts warranty to the authorised dealer. Any labour, call-out, travel, installation or other service costs associated with completing the repair will then be the responsibility of the equipment owner.
The supply of a replacement part to an authorised dealer does not constitute approval by HYPERFX for additional works, costs or services unless those works or costs have been expressly authorised by HYPERFX.
HYPERFX reserves the right, where reasonably necessary, to manage a warranty claim directly, appoint an alternative authorised service provider or make alternative service arrangements where the original selling dealer is unable or unwilling to complete the warranty work.
Where equipment was purchased through an authorised HYPERFX dealer, customers should lodge warranty claims with that dealer in the first instance unless otherwise directed by HYPERFX.
7. MAKING A WARRANTY CLAIM
We want warranty claims to be simple.
Where the equipment was purchased through an authorised HYPERFX dealer, the customer should contact that dealer in the first instance.
For equipment purchased directly from HYPERFX, the customer should contact HYPERFX or its nominated authorised service representative.
To assist us in processing a claim quickly, please provide:
1. Proof of purchase or equipment installation details.
2. Equipment model and serial number, where available.
3. A brief description of the issue.
4. Photos or video clearly showing the fault where reasonably requested.
HYPERFX may request additional information reasonably required to determine the nature and cause of the failure.
Once the claim has been assessed and approved, HYPERFX will arrange the appropriate replacement part or repair solution directly or through the selling dealer or authorised service provider.
HYPERFX may elect to repair or replace a defective component with a new, equivalent or functionally comparable component.
Replacement of a component under warranty does not restart or extend the original warranty period. The replacement component will remain covered for the balance of the original applicable warranty period.
8. WARRANTY CONDITIONS
This warranty applies to the original purchaser of HYPERFX Strength Series equipment and commences from the original date of purchase.
Warranty coverage is conditional upon the equipment being:
installed correctly;
used for its intended purpose;
operated in accordance with HYPERFX instructions;
kept in an appropriate operating environment;
reasonably cleaned and maintained;
inspected as appropriate for commercial fitness equipment; and
removed from use where a fault or safety issue is identified until the issue has been assessed or rectified.
HYPERFX may require reasonable evidence of maintenance, servicing or inspection where the nature of a failure suggests that maintenance or servicing may have caused or contributed to the issue.
Failure to properly maintain the equipment does not automatically void the entire warranty. However, HYPERFX may decline a particular claim where inadequate maintenance, servicing or inspection caused or materially contributed to the failure being claimed.
9. AUSTRALIAN CONSUMER LAW
This manufacturer's warranty is provided in addition to any rights and remedies available under the Australian Consumer Law and any other applicable legislation.
Nothing in this warranty is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
Where the Australian Consumer Law applies, the customer's statutory rights apply independently of the additional manufacturer's warranty provided by HYPERFX.
